This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.86/2014, registered at Police Station-Balrampur, District-Balrampur-Ramanujganj (CG), for the offence punishable under Sections 363, 366 & 376 of the IPC and Section 4 of the Protection of Children from Sexual Offences Act, 2012.

After hearing learned counsel for the parties and taking into consideration the nature and gravity of the offence, facts and circumstances of the case, role of the present applicant and the manner in which on 10.6.2015 the applicant is said to be kidnapped minor prosecutrix, who is aged about 12 years on the date of commission of offence and committed sexual intercourse with her, I do not find any ground for grant of regular bail to the applicant. Consequently, bail application is rejected. However, considering the fact that six witnesses have already been examined, the trial Court is directed to expedite the trial and conclude the same as early as possible. Sd/- (Sanjay K.
