Order of rejecting application for compassionate appointment has been challenged on the ground that though the petitioner's father was dismissed from service in departmental enquiry, the petitioner has filed the petition before this Court (WPS No.4396 of 2009) which is still pending. Therefore, in these circumstances, the application ought not to have rejected.

The order of dismissal has not been set aside by any authority or by this Court. If that be so, the benefit of compassionate appointment would not be available to the dependent of an employee, who was dismissed from the government service.

Therefore, the impugned order does not warrant any interference. The petitioner would be at liberty to revive his claim, depending upon the outcome of the pending litigation. 4.
