This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.38/2016, registered at Police Station-Arjuni, District-Dhamtari (CG), for the offence punishable under Section 20 (B) of the NDPS Act.

Case of the prosecution, in brief, is that the applicant was found in possession of 3.350 kg. of contraband article ganja without any authority of law.

Learned counsel for the applicant would submit that the applicant has not committed any offence and he has falsely been implicated in crime in question. He would further submit that statutory compliance has not been made. The applicant is in jail since 1.2.2016 and charge-sheet has been filed.

On the other hand, learned State counsel would oppose the bail application.

I have heard learned counsel for the parties and perused the case diary.

Taking into consideration the nature and gravity of the offence, facts and circumstances of the case and recovery of 3.350 kg. of contraband article ganja from the possession of the present applicant, I do not find any ground for grant of regular bail to the applicant. Consequently, bail application is rejected.
