Hon'ble Shri Justice Goutam Bhaduri Order On Board 25.02.2021 Heard.

1. Learned counsel for the petitioner submits that the petitioner's society has been granted lease, subject to the approval of Collector, on 17.10.2019 thereafter the lease deed was executed by Annexure P/2 and according to the Chhattisgarh Fisheries Policy and eventual permission for fishing has to be obtained which is to be given by the State. Therefore, the petitioner has made an application to the Collector by Annexure P/4 therefore

the Collector may be directed to decide the same within a specified time.

2. Perused the documents, it appears that the petitioner has been granted a lease in respect of the pond namely Kajartal at village Betari Gram Panchayat Jaitpur, thereafter the agreement has been executed subject to approval by Collector. According to the Annexure P/4, the petitioner has made an application to the Collector for grant of permission for fishing.

3. Considering the fact that the considerable time has been passed, the petitioner shall file a fresh application to the Collector with a copy of this order within a period of two weeks and if such application is filed, then the same shall be decided within a further period of six weeks from the date of receipt of such application.
