Shri Sushil Dubey, Advocate For Respondent/State :

Shri A. S. Kachhawaha, Additional AG Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 06/09/2017 Heard.

2.

At the outset, learned counsel for the petitioner submits that the order of cancellation of petitioner's absorption without affording opportunity of hearing is illegal and in respect of other similarly situated employees, whose absorption was also cancelled by the same impugned order, this Court had passed an order on 22-03-2017 in WPS No.760 of 2016 and batch of petitions setting aside the order of cancellation of absorption on the ground of violation of principles of natural justice.

3.

Learned State counsel submits that the case of the petitioner would require verification as to whether it is a case of similarly situated or not. 4.

On the face of order dated 22-03-2017 passed by this Court in WPS No.760 of 2016 and batch of petitions and that other persons, whose names are mentioned in the impugned order, have filed petitions challenging the order on those grounds, which are raised by the petitioner in this petition, I am inclined to hold that the petitioner's case is identical to those cases, who have earlier approached this Court.

5.

In view of the above, this petition is allowed on the same terms as ordered by this Court in the case of Dhananjay Prasad Pandey and others vs. State of CG and others, (WPS No.760 of 2016 and batch of cases vide order dated 22-03-2017). Resultantly, the impugned order is hereby set aside. SD/- (Manindra Mohan Shrivastava) Judge Tumane
