1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No.105/2019 registered at Police Station Bhilai Nagar, Distt. Durg (C.G) for the offences punishable under Sections 420, 467, 468, 471/34 of IPC.

2. As per the prosecution case, the applicant who was working as Manager in Gurunanak English Medium Senior Secondary School, Bhilai along with other accused has embezzled a total sum of Rs.19 lakhs approximately during the financial years of 2016-2017, 20172018 & 2018-2019, thereby the offence has been committed.

3. Learned counsel for the applicant submits that the applicant has been arrested on 17.01.2020; charge sheet has been filed in this case and no further investigation is necessary. He further submits that another accused namely Amit Roy has been granted anticipatory bail by the Coordinate Bench of this Court in M.Cr.C(A) No.642 of 2019 on 13.05.2019 and the case of the present applicant is also on similar footing of accused Amit Roy, therefore, this applicant may be

enlarged on regular bail.

4. Per contra, learned State Counsel opposes the bail application and submits that while granting anticipatory bail to the other accused, the nature of allegations have been attributed to this applicant.

5. Considering the nature of allegations as also the fact that the charge sheet has been filed and no further investigation is necessary and the applicant is said to be in jail since 17.01.2020, I am inclined to allow this bail application.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court for his appearance before the said Court as and when directed.
