The counsel appearing for the petitioner at the outset makes a request that the writ petition may be disposed of at this stage permitting the petitioner to make a representation before the respondents seeking for reconsideration of the case of the petitioner of suspension.

According to the petitioner, there is only around 4 months left for the petitioner to retire and further that the alleged misconduct against the petitioner in fact has never occurred for the reason that the alleged function stood cancelled and as such the misconduct is not made out prima-facie. This fact be considered by the authorities afresh.

Counsel for the respondents submits that so far as the petitioner seeking liberty to approach the authorities by way of a representation is concerned, the State may not have any objection. The representation if so made shall be duly considered in accordance with the Rules governing the field on its own merits. 4.

In view of the same, the writ petition at this juncture stands disposed of permitting the petitioner to make a representation before the respondents in respect of the order of suspension dated 08.02.2021 issued by the respondents. Upon the petitioner making any such representation, the authorities concerned are expected to take a decision on the said representation on its own merits in accordance with the Rules and Regulations governing the field, at the earliest preferably within a period of 45 days from the date of receipt of the copy of this order.

With the aforesaid observations, the present writ petition stands disposed off.
