Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 05/09/2017 Heard.
1. The petitioner, an employee, at the fag end of service, is going to retire on 31.05.2018 has represented the State for being transferred to his home district to Kondagaon, exercising his option in clause 1.9 of policy dated 11.07.2017. The Additional Commissioner (Excise) has also given a favourable recommendation vide memo dated 27.04.2017 to the Government but as the petitioner has not been considered for transfer, this petition has been filed.
2. In view of clause 1.9 of the transfer policy dated 11.07.2017, the petitioner is
entitled to consideration of his option. Let the petitioner's option be considered by the State in appropriate department and in case, it is found that the petitioner is entitled to be given posting in his home district, appropriate orders may be passed. The case, one way or the other, may be completed within one month from the date of receipt of copy of this order.
3. The petition is accordingly disposed off.
