Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 10/07/2015

1. The petitioner is working as Driver in the office of Deputy Director, Veterinary Services, Korba having been appointed on the said post on 12.7.2013. He is aggrieved by his attachment in the Tehsil office, Pali, District Korba.

2. Learned counsel for the petitioner would submit that since after his appointment, the petitioner is repeatedly sent on attachment to different offices which has uprooted his family, as he has to take care of his old infirm parents.

3. Since the petitioner has been appointed as Driver in the office of Deputy

Director, Veterinary Services, by very nature of his job, he is required to be posted at the places where services of driver are required. The last order attaching him at Tehsil office Pali mentions that the petitioner is sent for election work.

4. At this stage, learned counsel for the petitioner would submit that since election work is now over, the respondents may be directed to consider the petitioner's prayer for sending him back to his original place of posting i.e. the office of Deputy Director, Veterinary Services, Korba.

5. It appears, shifting the petitioner is the requirement of a particular office and his utility. Therefore, instead of interfering with the impugned order, the writ petition is disposed of with a direction that in the event the petitioner prefers a representation before the Collector, Korba raising his grievances on the subject issue within a period of one month from today, the said officer shall consider and decide the representation at the earliest, preferably within a period of 3 months from the date of receipt of representation.
