1. The present petition has been filed by the petitioner seeking for quashing of order dated 11.03.2015 (Annexure P/8) and for grant of retiral/

pensionery benefit arising from the death of the deceased employee late Bechanlal Thakur.

2. Pending the petition before this court, the respondents entered appearance and filed reply stating that petitioner No.1/wife of deceased employee has already been granted compassionate appointment vide order dated 23.04.2015 and have also filed document showing payment of terminal benefit like GPF, GIS and other monetary benefit is also filed.

3. At this juncture, counsel for the petitioners submits that the petitioner's only grievance left is with regard to non grant of pension to the petitioner.

Without keeping the present petition pending, in the light to submissions made by the Respondents/State in its return that retiral/lpensionary benefit as well as compassionate appointment has already been granted to the wife of deceased employee, this petition is disposed of with a direction to the petitioner to approach the competent authority for grant of pension in case the same is not released till now and in the event, if the petitioner makes an application in this regard, the respondents shall forthwith consider the said application for pension in accordance with rules and decide the same at the earliest preferably within a period of 45 days from the date of receipt of such application.

5. With the aforesaid observations, the writ petition is disposed of. No order as to costs.
