Mr. Avinash K Mishra, Penal Lawyer for the State. Counsel for the appellant wants to withdraw this appeal as according to him appellant has already preferred an appeal. He further submits that the certified copy of the impugned judgment may be returned.

Learned counsel for the State has no objection. Accordingly, the appeal is dismissed as withdrawn with the aforesaid liberty.
