(1) In an application filed under Section 125 of the Code of Criminal Procedure by the non-applicant/wife, the Family Court pending determination of final maintenance amount, by the impugned order, has granted Rs. 5,000/- per month as interim maintenance to the non-applicant finding that applicant is working as Teacher in the Industrial Training Institute, Raigarh which is government institution, and getting Rs. 40,000/- per month.

(2) After hearing learned counsel for the parties and taking into consideration the facts & circumstances of the case, in particular, the monthly income of the applicant/husband; need of the nonapplicant for her food, clothing and medical treatment, amount of interim maintenance cannot be said to higher side warranting interference by this Court under its revisional jurisdiction at this stage. However, the family Court is directed to conclude the trial expeditiously.

(3) With the aforesaid observations, the revision stands finally disposed off.
