1. The transfer order is under challenge on the ground that when the occasion arose for transferring the petitioner from one district to the other district, the petitioner is again being sent to a core scheduled area whereas clause 2.1 of the transfer policy dated 03.06.2015 requires consideration for posting an officer to non-scheduled area where he has remained posted in the scheduled area. The petitioner has remained posted in the scheduled area for the last 10 years and therefore, his case requires consideration for being posted outside the

scheduled area subject to other conditions stated in clause 2.1 of policy dated 03.06.2015.

2. Having considered that the petitioner has remained posted in the scheduled area since last 10 years, his case requires consideration whether subject to all the conditions mentioned in the policy dated 03.06.2015, he is to be posted outside the scheduled area.

3. If the petitioner prefers representation within 15 days from today, the same shall be considered and decided within 4 weeks from the date of receipt of copy of this order. For a period of 6 weeks, no coercive steps shall be taken against the petitioner.

4. The petition is accordingly disposed off.
