1. This is the second anticipatory bail application. This application under Section 438 of the Code of Criminal Procedure has been filed by the applicant apprehending his arrest in connection with Crime No.01/2016 registered at Police Station Anti Corruption Department (EOW), Raipur (C.G.) for the offence punishable under Sections 13 (1) (e) and 13 (2) of the Prevention of Corruption Act.

2. The First Anticipatory Bail Application bearing MCRCA No.1022 of 2017 was dismissed for want of prosecution on 27.03.2018.

3. Along with the anticipatory bail application a copy of the order dated 20.09.2017 passed in WPCR No.13 of 2017 which is filed by the present applicant, is

enclosed wherein the High Court has ordered to list that WPCR No.13 of 2017 for final hearing and in the meanwhile directed that no coercive steps shall be taken against the petitioner, till the next date of hearing. In view of this, at present there is no apprehension looms large on the applicant for arrest as already there is a protective order passed by this Court in WPCR No.13 of 2017, therefore, at present if any order is passed, it would be contrary to the earlier order passed by this Court on either side. Consequently, at present it appears that the present application for anticipatory bail is not maintainable as no apprehension of arrest exist. Accordingly, the anticipatory bail application is dismissed.
