Grievance of the petitioner is that even though, the competent authority has passed an order for payment of EPF and Gratuity, dues are not being paid. 3.

Learned counsel for respondent No.1 submits that against the order passed by the competent authority, an appeal has been preferred before the Tribunal and after complying with the condition of pre-deposit, an amount of EPF has been deposited before the appellate authority.

In view of above disclosure, it is for the petitioner to move an application before the appellate authority for release of the amount, if he is entitled under the law. If any such application is moved, the same shall be considered and decided by the appellate authority in accordance with law. 5.
