Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 13/09/2017 Heard.
1. The transfer order is under challenge on the ground that earlier the petitioner had served in the scheduled area for last 7 years and she is again being transferred to scheduled area which is in violation of clause 1.3 of circular dated 03.06.2015. The other ground is that the mother-in-law is old and son is studying at Balodabazar. Therefore, the transfer order may be quashed. There is nothing in clause 1.3 of circular dated 03.06.2015 that once an employee who has remained posted in scheduled area/ core scheduled area, cannot be again posted in that area.
The petitioner has remained posted at the present place for quite sometime. Therefore, she has become due for transfer. The other grounds are of only personal difficulty, which can be best appreciated by the competent authority.
2. The petitioner has already preferred representation. If the petitioner prefers a fresh representation along with copy of this order within 15 days from today, the same shall be considered and decided within four weeks.
3. The petition is accordingly disposed off.
