Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 04/10/2017 The petitioner has filed this petition challenging legality and validity of the order of imposition of penalty passed by the disciplinary authority. 2.

Though the order of imposition of penalty is challenged before this Court, learned counsel for the petitioner would submit that against the order of penalty and treatment given to the period of suspension, the petitioner has taken recourse to the remedy of statutory appeal but when the appeal has remained pending for the last 10 months, writ petition had to be filed. 3.

Considering that the appeal of the petitioner is still pending where the petitioner had an opportunity to assail factual finding also, I am not inclined to

entertain this petition. This petition is accordingly disposed off with a direction to the appellate authority to decide petitioner's appeal as early as possible, preferably within a period of three months.
