Hon'ble Shri Justice P. Sam Koshy Order On Board 06.04.2021

1. The grievance of the petitioner in the present writ petition seems to be the order Annexure P-1 which is firstly an order of recovery of an amount of Rs.2,30,274/- from the salary payable to the petitioner and secondly is also an order of punishment whereby the respondents have imposed a punishment of stoppage of one annual increment without cumulative effect.

2. Perusal of the record would show that the petitioner had immediately preferred a departmental appeal to the appellate authority where the appeal is pending consideration for more than a year now.

3. Given the fact that the departmental appeal of the petitioner is pending consideration before the respondents, the writ petition at this juncture stands disposed of directing the appellate authority to consider and decide the appeal, if it has till date not been decided, at the earliest preferably within a period of 60 days from the date of receipt of copy of this order.

4. The writ petition accordingly stands disposed of. Sd/- P. Sam Koshy Judge Khatai
