Shri Manish Nigam, Panel Lawyer S.B. Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 27/09/2017 Heard.

1. The transfer order is under challenge mainly on the ground that the petitioner is presently posted in scheduled area and he still wants to remain posted in the scheduled area and in the policy dated 3.6.2015, it has been provided in Clause 2.2 that those who are willing to continue, they may not be removed unless there is complaint and administrative decision taken to remove. It is also submitted that reliever has not come and that the petitioner is going to retire within 2 years.

2. As far as non-availability of reliever and retirement within 2 years is concerned, these are not matter covered under the transfer policy. Therefore, I am not inclined to consider the same.
