1. This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.62/2015 registered at Police StationDevbhog, Gariyabandh (C.G.) for the offence punishable under Section 420, 467, 468, 471, 406 R/w 34 of the Indian Penal Code 1860.

2. As per the prosecution case for the year 2014-15 paddy was transported from one destination to other, however it did not reach to other destination therefore different offences were registered.

3. Learned counsel for the applicant submits that the applicant is the driver of the vehicle whereas Sandeep Kotak and Ajay Sharma who were the main contractor they have been enlarged on bail by the coordinate Bench, therefore, the present applicant may be released on bail.

4. Learned State counsel do not dispute the fact that the co accused Sandeep Kotak and Ajay Sharma have been enlarged on bail.

5. Considering the fact that Sandeep Kotak and Ajay Sharma who were the main contractors have been enlarged on bail by the coordinate Bench, the charge sheet has been filed and the applicant is in jail since 11.06.2019, I am inclined to release the applicant on bail.

6. Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed. It is directed that the applicant shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
