Versus

1. State Of Chhattisgarh Through The Principal Secretary Department Of Higher Education D.K.S. Bhawan Mantralaya Raipur Chhattisgarh., District : Raipur, Chhattisgarh

2. Chhattisgar State Public Service Commission Through Its Chairman Shankar Nagar Road Bhagat Singh Square Raipur Chhattisgarh., District : Raipur, Chhattisgarh ---- Respondents For petitioners :

Mr. Shantam Awasthi, Advocate.

For State :

Mr. P. Acharya, PL For Respondent/s :

Mr. Y. C. Sharma. Advocate.

Hon'ble Shri Justice P. Sam Koshy Order on Board 21/02/2019 1.

The challenge in the present writ petition is to the action on the part of the respondents in not granting relaxation of age to the petitioner so far as his experience as Contractual Teacher as Assistant Professor is concerned. 2.

Perusal of the record would show that the petitioner while filing the present writ petition has shown his age to be more than 50 years which is much more than the permissible maximum upper age limit that is permissible inclusive of all relaxation if any which is 45 years of age. Therefore under no circumstances, in the opinion of this Court can the petitioner be considered for appointment now for a Government employment.

3.

Only on that ground, this Court is not inclined to entertain the present writ petition. Moreover, in between 2009 to 2018 there has been other recruitment process initiated by the Public Service Commission where the petitioner had an occasion of participating provided the rules permitted him for that.

4.

The writ petition at this juncture on this limited ground stands rejected. Sd/- (P. Sam Koshy) Rohit JUDGE
