Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 0 3 /0 8 /201 (1) After arguing for fairly long time, learned counsel appearing for the
applicant would submit that he may be permitted to withdraw this civil revision with liberty to file application under Order 8 Rule 6-C of the Code of Civil Procedure for exclusion of counter-claim before the trial Court. (2) Liberty is granted, as prayed for.
(3) Accordingly, the civil revision is dismissed as withdrawn with the liberty as aforesaid. However, if the applicant files an application under Order 8 Rule 6-C of the CPC before the trial Court, it is expected from the trial Court to decide the applicant's application expeditiously without being influenced by the order impugned.
