Learned counsel for the petitioner seeks permission of the court to withdraw this petition with liberty to file afresh. Prayer is allowed.

Accordingly, the petition is dismissed as withdrawn with liberty aforesaid.

However, dismissal of the petition is ordered without considering stand of the State at this stage.
