Shri Satish Gupta, Govt. Advocate for the State. Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 02/03/2016 This petition has been filed by the petitioner aggrieved by rejection of his nomination to contest the election.

Though learned counsel for the petitioner raises serious ground to persuade this Court that rejection of his nomination form was illegal, present is a matter arising out of election which is still in process.

In view of statutory scheme of the Cooperative Societies Act and that the election already commenced, I am not inclined to interdict the process of election. However, after election is over, the petitioner would be at liberty to raise election dispute under Section 64 of the Cooperative Societies Act.
