Aarti Rai W/O Shri Satish Rai, Aged About 32 Years R/O Indraprasthapuri Colony, Devnandan Nagar, Bilaspur, Tahsil & District Bilaspur, (Chhattisgarh) ---- Respondent 04/03/2016 Shri Vivek Shrivastava, counsel for the petitioner. This petition has been filed by the petitioner, in substance, seeking execution of the award passed by the Lok Adalat.
In view of provisions contained in Section 21 of the Legal Services Authority Act, 1987, every award of the Lok Adalat shall be deemed to be a decree of Civil Court. In the case of K.N.Govindan Kutty Menon vs. C.D.Shaji, (2012) 2 SCC 51, the Supreme Court held that an award of Lok Adalat would be treated as a decree of the Civil Court by virtue of deeming provision and the same would be executable by that court.
In view of above, the petitioner's remedy lies before
the competent Court to seek execution of the award of the Lok Adalat, in accordance with law.
With the aforesaid liberty, the petition stands dismissed.
