This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.53/2015, registered at Police Station-Gariyaband, District-Gariyaband (CG), for the offence punishable under Sections 363, 366 & 376 of the IPC and Sections 4, 6 & 12 of the Protection of Children from Sexual Offences Act, 2012.

After hearing learned counsel for the parties and taking into consideration the nature and gravity of the offence, facts and circumstances of the case and age of the prosecutrix, I do not find any ground for grant of regular bail to the applicant. Consequently, bail application is rejected. However, considering the fact that two witnesses have already been examined, the trial Court is directed to expedite the trial and conclude the same within a period of three months from the date of receipt of certified copy of this order.
