This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.
The applicant has been arrested in connection with Crime No. 35/2019 registered at Police Station- Chhuikhadan, District- Rajnandgaon (C.G.) for the offence punishable under Section 34(2), 34(1) of the CG Excise Act. 3.
Case of the prosecution, in brief is that on 05.02.2019, 5.475 bulk liters of foreign as well as country made liquor were seized from the possession of the applicant. 4.
Goverment Advocate submitted that 5 other criminal cases have been registered against the applicant out of which 2 under Excise Act and 3 under Cr.P.C. 5.
Counsel for the applicant further submitted that one Excise case is of 2014 and in this case applicant has been already acquitted. Thus, applicant may be released on bail.

Looking to the facts and circumstances of the case, looking to this fact that 5 other criminal cases have been registered against the applicant, the bail application is rejected.
