Learned counsel for the petitioner would submit that he may be allowed to prefer an appeal before the appellate authority. 2.

Prayer appears to be fair and reasonable.

The petitioner is permitted to file an appeal before the

appellate authority. If such appeal is made by the petitioner within a period of 15 days from today, the appellate authority would do well to consider and decide the same on its own merit and in accordance with law preferably within a period of 45 days from the date of presentation of the appeal after hearing both the parties. 4.

With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).

It is made clear that this Court has not expressed any opinion on the merits of the case and the appellate authority may decide the appeal on its own merits.
