In the return filed by the respondents -State, it has been clearly averred that the proceedings of eviction initiated against the petitioner, out of which this petition has arisen, have now been closed looking to the fact that the possession of the petitioner over the disputed land was found legal. Further in para-4 of the reply, it has been

stated that proceedings under Section 248 of the Land Revenue Code has been closed and the petitioner has been exonerated from proceedings and, therefore, nothing remains in the instant petition.

In view of the aforesaid categoric statement made on affidavit in the reply of respondent-State, nothing survives for consideration. Petition is accordingly disposed off.
