ORDER

13.05.2020 1.

This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.157/2019 registered at Police Station- Ramanujnagar, District Surajpur (C.G.) for the offence punishable under Sections 420, 409, 467, 468, 471, 120-B, 34 of Indian Penal Code.

As per the prosecution case, one D.K.Vishwakarma lodged a report that he availed certain loan from the Central Bank in the year 2017 and without his consent an amount of Rs.6 Lacs was transferred to another account in the year 2019 by Alok Kumar, the Branch Manager and the present applicant who was also the Assistant Branch Manager and thereafter the amount was released. 3.

Learned counsel for the applicant would submit that the applicant is in jail since 13.12.2019, trial will take time, charge sheet has been filed and no further investigation is necessary; therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Considering the pretrial detention of the applicant as he is in jail since 13.12.2019 and the fact that the charge sheet has been filed, I am inclined to release the applicant on bail. Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed. 6.

It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed. Sd/- (Goutam Bhaduri) Judge Ashok
