Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 25/09/2017 The petitioner's grievance is on account of inaction on part of the respondents in not granting compassionate appointment to the petitioner. 2.

The pleadings of the petitioner show that the father of the petitioner, while working as Assistant Internal Audit and Taxation Officer, Janpad Panchayat, Tamnar died on 13/10/2015. An application for compassionate appointment was made on 24/05/2016. However, till date, decision on the same has not been taken. It is informed to the Court that as the deceased employee belonged to the State cadre and not the Panchayat cadre, his case should be decided by respondent No.2.

State counsel submits that the petitioner's case for compassionate appointment would be considered in accordance with the policy existing as on 13/10/2015 by the competent authority of the department of Panchayat. 4.

In view of the submission so made before this Court, I am not inclined to keep this matter pending. The petition is accordingly disposed off with a direction to respondent No.2 to examine either by himself or direct any other officer subordinate to him for consideration of petitioner's claim of compassionate appointment and pass order within a period of 90 days from the date of receipt of copy of this order. It goes without saying that in case, petitioner's grievance is still not redressed, he would be at liberty to take recourse to remedy available to him under the law.
