Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 26/09/2017 Heard.

1. The petitioner's grievance as ventilated through this petition is that even though he has been transferred while he was sent on deputation vide order dated 14.08.2017 of the State Government, pursuant to which, he joined on 17.08.2017 and allowed to work. All of a sudden, on 01.09.2017, a remark has been entered in the attendance register by the District Education Officer that the petitioner's joining will be accepted only after the order of the Collector.

2. Upon being enquired from the State counsel, learned State counsel would submit that the order of the State Government is supreme in administration

and it is not subject to approval of subordinate authority including the Collector.

3. In view of the above, this petition is disposed off with the direction that unless there is any instruction received by the State Government in the matter of deputation of the petitioner, the petitioner shall be allowed to continue at the present place of posting and paid his salary.
