Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 25/09/2017 Learned counsel for the petitioner submits that during the petitioner's husband was in service, he became entitled for grant of time bound pay scale and claim has also been allowed by recommendation but before the order could be passed for grant of higher pay scale, the husband of the petitioner died on 25/04/2017. 2.

As the monetary claim had already been approved in favour of the deceased employee, petitioner who is the widow, the successor of the deceased, has filed this petition for payment of monetary benefit in the form of higher pay scale from the due date till the date of death of the employee.

Considering the aforesaid submission, particularly taking into consideration the approval of claim of monetary benefit in favour of the deceased employee prior to his death, the matter is required to be considered and appropriate order is required to be passed in the matter and the claim benefits be extended to the petitioner.

Respondent No.2 shall examine the claim and decide the matter within a period of 90 days from the date of receipt of copy of this order. 4.
