(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 238/2015 registered at Police Station Chouki Malhar, P.S. Masturi, Distt. Bilaspur (C.G.) for the offences punishable under Sections 34(1)(A) & 34(2) of the C.G. Excise Act. (2) Applicant's first bail application was dismissed on merits by this Court by order dated 13.10.2015 passed in M.Cr.C.

(3) Having heard learned counsel for the parties, having regard to the facts & circumstances of the case; I do not find any change in circumstances to entertain this second bail application. Thus, the bail application is rejected.
