Hon'ble Shri Justice P. Sam Koshy Order On Board 01/05/201 This is the first bail application filed u/s 439 of Cr.P.C. for grant of bail to the applicants who are in jail since 12.05.2017 in connection with Crime No. 82/2017 registered at Police Station- Khallari, District Mahasamund (CG) for the offence punishable under Section 20(B) of NDPS Act.

Perusal of the record reflects that most of the prosecution witnesses have been examined even the material witness i.e. the Investigating Officer has been examined and the case has been adjourned for further cross-examination of the I.O. This itself reflects that the trial has reached at the fag end stage. Given the facts and

circumstances of the case, this Court is not inclined to grant bail to the applicants at this juncture.

Accordingly, the application filed under Section 439 CrPC for grant of bail stands rejected.
