1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested on 06.11.2020 in connection with Crime No.205/2020 for offence under Section 34 (2) of the C.G. Excise Act, registered at Police Station- Jhagrakhand, Koriya, District- Koriya (C.G.).

2) At the outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file a fresh application as and when occasion arises.

3) Learned State counsel submits that number of cases under Excise Act are pending against the present applicant. Learned State counsel further submits that he has no objection to the above prayer.

4) Permission granted.

5) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
