1. This application under Section 438 Cr.P.C. has been filed by the applicant apprehending his arrest in connection with Crime No.14 of 2018 registered in Police Station- Nawagarh, District- Bemetara for alleged commission of offence under Sections 354, 376, 511, 323 IPC.
2. Learned counsel for the applicant would submit that the applicant is being involved only on certain suspension. He would submit that there is delay in lodging FIR and the victim is deaf & dumb and only on certain signs, the investigating agency has jumped to the conclusion that the applicant is the accused.
3. On the other hand, learned counsel for the State opposed the bail application. He would submit that the investigating is still going on and the applicant will have to put for test identification parade. Therefore, at this stage, the applicant
-2is not entitled to benefit of anticipatory bail.
4. Having considered the submissions made by learned counsel for the parties, taking into consideration the nature and gravity of allegation, I am not inclined to protect the applicant.
