By this petition, the petitioner has challenged transfer order dated 14-08-2017 on the ground that the petitioner has been transferred within a period of less than one year from the date of first joining at the place where he is working at present. It is submitted that earlier, the petitioner was transferred vide order dated 30-07-2016 and he was relieved only on 15-09-2016 to join at the present place-Devgarh. Therefore, his total period of service at the present station is less than one year and in view of the provisions contained in the transfer policy, 2016, the petitioner ought not to transfer within a period of less than one year.

As the petitioner has been transferred within a short period from the date of first joining, this matter requires consideration by the competent authority. The petitioner has already preferred representation. Let a copy of this order along with fresh representation be submitted before the competent authority within a period of three weeks. Representation of the petitioner shall be considered and decided thereafter within a further period of four weeks. It is directed that no coercive steps shall be taken against the petitioner for a period of six weeks on the ground of non joining at the transferred place. 4.

With the aforesaid observation/direction, this petition is finally disposed off.
