In an application for maintenance proceeding under Section 125 of the Cr.P.C. initiated by non-applicant herein claiming maintenance from the applicant, the Family Court in its order dated 02/03/2015 finding that the fact of marriage is not in dispute and the applicant is earning Rs.43,470/- per month as he is doctor by profession and granted Rs.9,000/- per month as an interim maintenance during the pendency of final maintenance proceeding, which is sought to be challenged in this criminal revision. 3.
After hearing learned counsel for the parties and taking into account the fact that marriage is not in dispute and the income of applicant is
Rs.43,470/- per month; considering the financial status and need of the nonapplicant, I do not find any illegality or jurisdictional error in the criminal revision and same is dismissed at the stage of admission without notice to other side. However, Family Court is directed to expedite maintenance proceeding.
