Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 27/09/2017 The transfer order is under challenge on the ground that the petitioner is entitled to exemption for a period of three years on the ground of petitioner being a district level office bearer of Employees' Union in view of the policy dated 25/08/2004.

It is submitted that earlier, the petitioner was transferred from Bemetara to Durg vide order dated 15/07/2014 but later on, it was cancelled on 12/03/2015. That order was challenged by the petitioner before this Court and the petition was disposed off vide order dated 23/06/2015 with a direction for consideration. 3.

In view of the aforesaid disclosure of fact and policy of 2004, the case of the petitioner requires consideration by the respondents. The petitioner has filed this petition without moving representation before the authorities. 4.

Let a representation be made within two weeks from today and the same

shall be decided by the authorities within a period of four weeks. For a period of six weeks, no coercive steps shall be taken against the petitioner.
