1. The grievance of the petitioner is that the petitioner's application for his retirement on medical grounds as per provision contained in clause 9.4.0 of National Coalwage Agreement-VI and consideration of case of his son for employment in place of the petitioner, has remained pending without any decision till date.

2. Learned counsel for the respondent submits that if such application has remained pending, the same shall be considered in accordance with the existing policy based on the report of the medical board and other relevant considerations and eligibility.

3. At this stage, when a decision of petitioner's representation has not been taken, in view of the statement made by learned counsel for the respondent, I am not inclined to keep this matter pending but to dispose off the petition with the direction to respondent to examine the petitioner's claim and decide the same as early as possible preferably within a period of two months from the date of receipt of copy of this order.

4. It is made clear that this Court has not commented upon the merits of the claim of the petitioner.

5. The petition is accordingly disposed off.
