Transfer order is under challenge on the ground that the petitioner being the District Level Office bearer of the Union and as per government policy dated 25-08-2004, he is exempted from transfer for a period of three years. The petitioner has been transferred to present place of posting only on 06-06-2016, therefore, he has not completed three years.

In view of the government policy dated 25-08-2004, exempting from transfer for a period of three years to the office bearer of the Union of

employees, matter requires consideration by the competent authority. The petitioner has already preferred representation. The petitioner shall submit a fresh representation along with a copy of this order before the respondent authority within a period of two weeks. Thereafter, the respondent authority shall consider and decide the representation of the petitioner within a period of four weeks from the date of receipt of representation. For a period of six weeks, no coercive steps steps shall be taken against the petitioner to compel him to proceed on transfer under the impugned order. 3.
