Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 27/11/2017 Heard.

The applicants have been arrested in connection with Crime No.52/2017 registered at Police Station - Fingeshwar, District - Gariyaband (CG) for alleged commission of offences under Section 457 and 380 of IPC. 2.

Case of the prosecution is that the applicant entered the premise where marriage ceremony was going on and stolen two mobiles. 3.

Learned counsel for the applicants submits that the applicants have been falsely implicated. They were present at the spot to take video coverage as there was marriage ceremony going on and when the mobiles were stolen, the applicants were involved in the case.

On the other hand, learned State counsel opposes bail application. 5.

Taking into consideration the submission of learned counsel for the parties,

nature of allegations and allegations are of theft of mobile, applicants are in jail since 23/08/2017, investigation is complete, charge sheet has been filed and also that the applicants have no criminal antecedent of similar nature, I am inclined to grant bail to the applicants.

Accordingly, the application is allowed. It is directed that the applicants shall be released on bail on each of them furnishing a personal bond in the sum of Rs.25,000/- along with one local surety for the like amount to the satisfaction of the Trial Court. They shall appear before the Trial Court regularly on each and every date, unless exempted from appearance.
