After some arguments, in view of the counter-affidavit filed on behalf of Respondents No. 1, 2 and 4 with regard to ineligibility of the Petitioner to participate in the tender, leave is sought to withdraw the writ petition reserving the right to agitate issues with regard to variation in turn over capacity of tenderer between one District and another in an appropriate case, as and when necessary.

The writ petition is dismissed as withdrawn with the aforesaid liberty.
