1. Learned counsel for the petitioner submits that date of birth of the petitioner is 1-9-1960, whereas in service record it has been wrongly recorded as 16-10-1949 and on that basis he has been retired. He further submits that date of birth of the petitioner has not been correctly mentioned and the matter has not been referred to the age determination committee as per Implementation Instruction No.76.

2. Be that as it may, the matter is directed to be referred to the age determination committee for determination of age of the petitioner and the committee will decide and determine the age of the petitioner expeditiously within a period of four months form the date of receipt of a copy of this order.

3. With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
