This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.78/2015, registered at Police Station-Gudhiyari, District-Raipur (CG), for the offence punishable under Section 376 of the IPC and Sections 3(A) (B) and 4 of the POSCO Act. 2.

After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances, nature and gravity of the offence and the manner in which the applicant is said to have been committed sexual intercourse with the prosecutrix who is aged about 9 years, this Court is not inclined to release the applicant on regular bail. 3.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
