1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested on 02.09.2020 in connection with Crime No. 284/2020 for offence punishable under Section 306 of IPC, registered at Police StationKharora, District- Raipur (C.G.).

2) After arguing for sometime, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file afresh as and when occasion arises.

3) Counsel for the State has no objection to the above prayer.

5) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
