NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR WPS No. 1630 of 2018 Smt. Kaushilya Chaturvedi W/o Shri Harshwardhan Chaturvedi, aged about 30 years, working as Assistant Teacher (Panchayat) at Govt. Primary School, Gudi Block, Masturi, District Bilaspur (C.G.). ---Petitioner

Versus

1. State Of Chhattisgarh, Through Secretary, Department of Panchayat and Social Welfare, Mahanadi Bhawan, Mantralaya, New Raipur (Chhattisgarh).

2. Chief Executive Officer, Janpad Panchayat Masturi, District Bilaspur (C.G.).

---Respondents For petitioner :

Shri Ajay Shrivastava, Advocate.

For respondent No.1/State :

Shri Manish Nigam, Panel Lawyer.

Hon'ble Shri Justice P. Sam Koshy Order on Board 21/02/2018 1.

Present petition has been filed challenging the order of transfer dated 10/11/2017 whereby the name of the petitioner finds place at Sr.No.77 transferring the petitioner from Primary School, Gudi to Manikchouri. 2.

The limited prayer which the counsel for the petitioner has made is that, the petitioner herein is pregnant and at this stage it would be most inconvenient for the petitioner to act upon the order of transfer. It would also create great inconvenience to the entire family of the petitioner. 3.

The State counsel however submits that, it is the respondent No.2 who has passed the impugned order and it is the respondent No.2 alone who has to take steps in regard to redressal of the petitioner's grievance.

4.

Given the aforesaid facts and submissions made by the counsel for the either side, this Court is of the opinion that ends of justice would meet if the petitioner is directed to file a detailed representation to the respondent No.2 within a period of 10 days from today along with all the relevant documents in respect of her claim and the respondent No.2 in turn shall pass an appropriate order preferably within a further period of 4 weeks' from the date of receipt of the representation. It is ordered accordingly. 5.

Meanwhile, there shall be a stay of effect and operation until the representation is finally decided.

6.

With the aforesaid directions, the Writ Petition stands disposed off. Sd/- (P. Sam Koshy) Sumit JUDGE
