Sam Koshy Order On Board 30/11/2017 This is the first bail application filed u/s 439 of Cr.P.C. for grant of bail to the applicant who has been arrested in connection with Crime No. 535/2017 registered at Police Station Jutmill Chowki, PS Kotwali, District Raigarh (CG) for the offence punishable under Sections 3, 4, 5 of Immoral Traffic (Prevention) Act, 1956 The applicant is in jail since 09.09.2017. 2.

As per the prosecution case, the present applicant on a raid being conducted was found in an objectionable condition. 3.

Counsel for the applicant submits that the applicant is in jail since 09.09.2017, as such she has already remained in custody for a period of more than two months and this is the first offence committed by her. Thus, considering the nature of offence the applicant may be released on bail. 4.

State counsel, however, opposes the bail application. 5.

Considering the period of custody already undergone and the nature of offence, this Court is of the opinion that it is a fit case for grant of bail to

the applicant.

Accordingly, the application for grant of bail is allowed. It is directed that the Applicant shall be released on bail on her furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court for her appearance before the said Court as and when directed.
