Agrawal Order On Board / 11 /201 (1) Learned counsel appearing for the parties would submit that the matter is covered by the decision of the coordinate Bench of this Court passed in W.P. (227) No. 355 of 2009 (Manager, C.G. State Co-operative Marketing Federation Ltd. vs. Ramvati Naurange) and other connected matters, decided on 23.11.2016, by which in paragraph 7 this Court has held as under:- "4. While passing the orders, both the Controlling Authority and the Appellate Authority had examined all the aspects of the case, including the law point raised by the petitioner, in light of the evidence on record and the law governing the field. It has been held by the Controlling Authority that the private respondents were not employed by

the contractor and were in fact employees of the petitioner. The said finding has been affirmed by the Appellate Authority by a well reasoned order. This Court finds no reason to interfere with the concurrent findings arrived at by both the authorities. Moreover, the order passed by the Appellate Authority has not been assailed in these writ petitions and on this count also, the petitions are liable to be dismissed."

(2) In view of above, the writ petition is disposed of in terms of paragraph 7 of the decision rendered by this Court in the case of Manager CG State Co-operative Marketing Federation Ltd. (supra). No order as to cost(s).
